Acceptable Use Policy (AUP)

1. Purpose

This Acceptable Use Policy ("AUP") governs your use of the eKnoxx platform, including:

• Cold email automation
• Opt-in marketing campaigns
• Transactional messaging
• Smart Inbox
• List Vault
• Email hygiene tools
• Identity Graph & enrichment services

By using eKnoxx, you agree to comply with this AUP.

Violation may result in immediate suspension or termination without refund.

2. Zero Tolerance for Illegal Spam

You may not use eKnoxx to:

• Send unlawful unsolicited commercial email
• Violate CAN-SPAM (USA)
• Violate GDPR (EU)
• Violate CASL (Canada)
• Violate any applicable anti-spam or privacy law
• Evade spam filters or conceal sender identity
• Use misleading subject lines or header information
• Falsify sending domains or impersonate others

You are solely responsible for ensuring legal compliance in every jurisdiction where recipients reside.

3. Prohibited List Sources

You may not upload or send to:

• Purchased lists without lawful basis
• Scraped lists obtained unlawfully
• Lists obtained through data theft
• Lists containing individuals who opted out
• Suppression lists from other platforms for abuse purposes

You must maintain lawful basis for contacting all recipients.

4. Required Email Practices

You must:

• Include a valid physical mailing address
• Provide a functioning unsubscribe mechanism
• Honor unsubscribe requests promptly
• Avoid deceptive or manipulative content
• Monitor bounce and complaint rates

Failure to maintain acceptable complaint rates may result in suspension.

4A. List Vault Marketplace Use

If you publish or rent a List Vault marketplace asset, you must follow additional marketplace controls.

• Do not publish a rentable list unless you have the right to license campaign-use access for that audience.
• Do not use rented list access to recreate, export, scrape, mirror, or otherwise capture the protected audience outside the platform.
• Do not misrepresent list freshness, source, tags, response quality, or intended niche.
• Do not use marketplace rentals to evade unsubscribe handling, complaint handling, or suppression controls.

5. Complaint & Abuse Thresholds

We monitor:

• Spam complaints
• Bounce rates
• Blacklist events
• Abuse reports
• Regulatory notices

If your activity poses risk to:

• Deliverability infrastructure
• Platform reputation
• Domain/IP health

We may suspend or terminate immediately without notice. No refund will be issued for violations.

6. Identity Graph & Enrichment Use

You may not:

• Resell Identity Graph data
• Redistribute enrichment data as a standalone dataset
• Reverse engineer data sources
• Extract bulk enrichment data for external resale
• Use data for unlawful surveillance or discrimination

All enrichment data is provided "AS IS" without guarantee of accuracy.

You are responsible for lawful use.

7. Fraud & Payment Abuse

You may not:

• Use stolen payment methods
• File fraudulent chargebacks
• Dispute legitimate subscription charges
• Attempt to bypass billing systems

Filing an improper chargeback may result in:

• Immediate termination
• Permanent ban
• Collection or legal action

8. Prohibited Content

You may not use eKnoxx to send content that:

• Is illegal or fraudulent
• Promotes hate, violence, or harassment
• Contains malware or malicious links
• Violates intellectual property rights
• Promotes illegal goods or services
• Involves phishing or impersonation
• Promotes deceptive investment schemes

We reserve sole discretion to determine violations.

9. Security Abuse

You may not:

• Attempt to probe or breach platform security
• Reverse engineer platform technology
• Circumvent usage limits
• Use bots to manipulate platform systems
• Interfere with service integrity

10. Suspension & Termination Rights

We reserve the right to:

• Suspend without notice
• Terminate without notice
• Revoke access immediately
• Delete account data
• Report violations to authorities

Termination for AUP violations results in:

• Forfeiture of subscription fees
• No refund eligibility
• Permanent ban where applicable

11. Investigation Rights

We may investigate suspected violations and:

• Review campaign content
• Review complaint data
• Cooperate with regulators
• Disclose information where legally required

12. Global Compliance Responsibility

Because eKnoxx operates globally, you are responsible for complying with:

• GDPR
• CAN-SPAM
• CASL
• UK GDPR
• Australian Spam Act
• Any local anti-spam law

We do not provide legal advice.

13. No Warranty of Deliverability

We do not guarantee:

• Inbox placement
• Open rates
• Response rates
• Data accuracy
• Compliance outcomes

You assume full responsibility for campaign results and regulatory compliance.
